Today, the Delhi High Court asked the Central Bureau of Investigation (CBI) to submit documents and give reasons to support its application seeking cancellation of the anticipatory bail granted by the trial court in January to self-styled godman Daati Maharaj and three others in a rape case.
The court asked the CBI to bring the proposal and other relevant documents before it on the next date of hearing, February 26.
The bench of Justice Chander Shekhar asked CBI about what steps they had taken to take him into custody since the matter was transferred to the agency from the Delhi Police in October 2018 by the Delhi High Court. The agency was also asked to explain why it is seeking his custodial interrogation.
The CBI prosecutor said that the alleged crime happened in Rajasthan; the Delhi Police registered an FIR and then it was transferred to the agency, therefore, they need two things to form an opinion in the case. First, re-examine the witnesses to see if they were examined properly by the earlier agency and Second, if they were cooperating in the case.
Notably, Daati Maharaj had filed a petition seeking review of the court's decision transferring the rape probe to the CBI which was dismissed by the court on November 14, 2018.
Brief background of the case, a complaint was filed on June 7, 2018, and an FIR was registered on June 11 at Fatehpur Beri police station in South Delhi against Daati Madan Lal alias Daati Maharaj along with three associates namely Ashok, Arjun and Anil for raping and unnatural sex with a 25-year-old disciple at his Ashram on January 9, 2016.
The case was later transferred to CBI who had registered a case of rape and unnatural sex against Daati Maharaj on October 26. The accused in his claims said that he was being framed.
