Justice Chander Shekhar of the Delhi High Court yesterday sought the response of self-styled preacher Daati Madan Lal alias Daati Maharaj on the petition filed by CBI seeking cancellation of anticipatory bail granted to him in a rape case on the grounds that he would not cooperate in the investigation, three other accused were also asked to give their response on it.
The CBI is handling the case on the directions of High Court who had earlier transferred the probe to the agency.
Datti Maharaj had filed a petition asking the court to review its decision of transfer but on November 14 last year, the court had dismissed the plea after considering the plea moved by the victim herself and further said that it had gone through the charge sheet in detail.
The brief background of the case, the complainant has filed the case against the preacher Daati Maharaj, his three brothers and a woman at Fatehpur Beri police station in South Delhi on June 7, 2018.
The FIR was registered after three days of the complaint on June 11, 2018, and charged him with the rape of a disciple at his ashrams in Delhi and Rajasthan. The police interrogated the accused on June 22, 2018.
In October, 2018, the High Court said the way in which the probe was carried out by the police “casts a shadow on the investigation” as the police did not arrest the accused in the case even after recording the complainant’s statement before a Magistrate under Section 164 of the Criminal Procedure Code.
Datti Maharaj initially had filed a plea against October 2018 order in Supreme Court which had then directed him to approach the High Court with the grievance. The case was later transferred to the crime branch.
Then on October 26, 2018, the CBI had registered a case of rape and unnatural sex against Daati Maharaj. The accused has claimed that he was being framed.
The court listed the case for further hearing on August 26, 2019.
